The agreement, in plain words.

Name Battle is the trading name of a sole proprietorship based in Kyiv, Ukraine (“we”). These terms are an agreement between you and that business as the operator of babynamebattles.com. By using the site you accept them; if you do not, please do not use it. You must be an adult to create an account or make a purchase — the site is for parents and the people they invite.

Where these terms and a mandatory consumer law of your country disagree, the law wins, and nothing here takes away a right it gives you.

Name Battle helps people choose a baby name: an encyclopedia of names built on official statistics, and six games — couple swipe, name battle, family vote, tournament, reveal game and full comparison — that end in a decision. The pricing page says exactly what is free and what Name Battle Unlimited adds; the data page says where every number comes from.

An account is optional. When you create one — with a one-time sign-in link or with Google — keep the email address current, and do not share the account: the games and purchases on it belong to the person who holds that address. We may close accounts that are used to abuse the service.

Name Battle Unlimited is a one-time purchase at the price shown on the pricing page — while our current discount runs, $9.99 against a regular price of $14.99, with the difference applied as a discount at checkout — plus any tax that applies where you live. It unlocks the features listed on the pricing page for as long as Name Battle Unlimited remains available and the account is in good standing, and it includes every feature we later add to Unlimited at no extra charge. It is not a subscription: it does not renew, and there are no recurring charges.

“Unlimited” means the counted limits on the games you create no longer apply. It is not a licence for automated or bulk use: the anti-abuse limits in the Fair use section apply to every account, and a paid account in good standing keeps its access under them.

Unlimited belongs to the account that bought it. The people you invite to your games play without an account and without charge; a game they start themselves uses their own plan, except that dealing the next deck in a couple-swipe chain you started is part of your game and is covered by your Unlimited.

We may change the price for future buyers, and the current discount will end. A purchase you have already made is never billed again and never re-priced.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

That means Paddle, not us, is the seller of record: it takes the payment, charges any tax due, issues the receipt, keeps the card details and handles refunds. Paddle’s buyer terms apply to the transaction itself; these terms apply to the service you unlock with it. Unlimited is switched on when Paddle confirms the payment to us, normally within seconds.

Name Battle Unlimited is digital content delivered immediately. Because the free plan lets you try every game first, purchases are generally final once Unlimited has been delivered or used — except where the law gives you a right to a refund, where you were charged twice, or where a real technical problem stops you using what you paid for and we cannot fix it within a reasonable time. Where the law allows it, asking for immediate access means you waive a statutory right to withdraw; where it does not, your right stands.

The refund policy spells out when a refund is available, how to ask, and what happens after.

Whatever you put into the site — names, notes, poll questions, shortlists — stays yours. You give us the permission we need to store it, run the games with it and show it to the people you send a link to; nothing more. You can delete it, or ask us to, at any time.

You are responsible for what you enter. Do not use the games to harass anyone, do not put other people’s private information into a poll, and do not post anything unlawful. We may remove content that breaks these rules.

• No automated voting, vote-stuffing, spam or harassment in any game.
• No scraping, crawling or bulk-downloading the site, and no reselling its data, reports or stories.
• No probing, overloading or interfering with the service or its security.
• Rate limits that guard against automated use apply to everyone, including Name Battle Unlimited; they are set well above what a family deciding on a name will ever reach.

We may close polls or accounts that break these rules. A paid account in good standing keeps its access.

The statistics come from the US Social Security Administration and the other agencies named on the data page; the underlying counts are public records. The way we compute, arrange, write about and draw them — the stories, the guides, the charts, the design and the code — belongs to Name Battle. You may use the site for personal, non-commercial purposes, and you are welcome to link to any page or quote from it with attribution. The rise-and-fall dataset may be reused with a link back.

Name Battle and babynamebattles.com are our names; please do not use them to suggest we endorse something we do not.

We provide tools and official statistics to help people compare names. We do not guarantee that you, your partner or anyone you invite will agree on a name, or settle on one at all. Name meanings, stories and cultural notes are editorial content offered for inspiration; nothing on the site is legal, medical, psychological or other professional advice. The final decision — and the responsibility for it — is happily yours.

We work to keep the site available, but it is provided as it is, and it may be interrupted for maintenance or for reasons outside our control. We may change, add or retire features. If a change would materially reduce what Name Battle Unlimited includes, we will say so on the site in advance; if we ever have to withdraw Unlimited entirely, we will tell account holders by email first.

You may stop using the site at any time and ask us to delete your account. We may suspend or end access for a breach of these terms, after telling you why unless the law prevents it.

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss arising from something we could not reasonably control, and our total liability to you for anything connected with the service is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection rules — and nothing limits your statutory rights as a consumer.

When these terms change, the date at the top changes with them. A change that affects a purchase or an account is announced on the site before it takes effect, and by email to account holders. Continuing to use the site after that date means you accept the new terms.
